Important Limitations of Notarial Services
At The Apostille & Notary Experts, we’re committed to providing a smooth, professional, and stress-free notary experience. To ensure every notarization complies with state and federal law, it’s important to understand what a Notary Public can—and cannot—do.
While we’re happy to guide you through the notarization process, there are certain limitations we’re legally required to follow. These boundaries are in place to protect both you and the integrity of your documents.
We kindly ask that you review the following restrictions before your appointment:
We cannot accept identification that is expired (issued over 5 years ago), damaged, taped, missing key information, or contains a photo or description that does not reasonably match the signer.
We cannot accept digital copies or screenshots of an ID on a cell phone. Identification must be physical, tangible, and government-issued.
We cannot notarize documents unless all signers are physically present and able to communicate clearly and directly with the notary.
We cannot use interpreters during the notarization. The signer must communicate in a language the notary understands. This ensures the notary can confirm understanding and willingness without relying on a third party.
We will not proceed if the signer appears unaware of what they are signing or unable to understand it.
We are not attorneys and therefore cannot offer legal or real estate-related advice, guidance, or interpretations.
We cannot provide or prepare documents for you. All paperwork must be completed, reviewed, and ready at the time of the appointment.
We will not notarize documents that contain:
Blank lines, empty fields, or unchecked boxes
Missing pages or required attachments
Name discrepancies between the document and the signer’s ID (such as suffixes like Jr., Sr., III, etc.)
We also cannot complete a notarization without proper identification, required witnesses, or a valid verbal oath/affirmation when applicable.

The law mandates that we verify a signer's identity through satisfactory evidence. This duty is non-negotiable. As notaries, we cannot waive these requirements based on convenience, relationship, or even pressure from a client or customer.
As notaries, we are public officials bound by an oath to the Secretary of State to serve impartially. We are expected to decide based on what's right, even when the law doesn't provide clear direction.
We promise to uphold the California Secretary of State's laws and duties, serve without bias, and perform our duties faithfully. This oath is not conditional on whether or not our work is recognized, praised, or even appreciated by others.
